If statesââ¬â¢ rights were more important, gay marriage would not be legal in some states, but normal in others. States have the flexibility to make laws within Federal guidelines. For example, the death penalty is legal in Texas, but not in Iowa. It is up to the Supreme Court to interpret the laws passed by Congress, states, and other judicial rulings.
